Democrats and crypto: 18 senators backed GENIUS, none voted to advance CLARITY

Democrats take both chambers of Congress on 3 January, with at least 51 Senate seats by the Associated Press count. The record of Democrats on crypto splits by bill. In 2025, 18 Senate Democrats helped pass the GENIUS stablecoin law. On 15 September this year, no Democrat voted to advance the CLARITY market structure bill, and it fell 49 to 50.

House Democrats have crossed over more often. The Solana Policy Institute counts these votes:

  • 21 voted to overturn SAB 121, the SEC’s accounting guidance for crypto custody;
  • 76 backed repeal of the IRS broker rule;
  • 78 voted for CLARITY in July 2025.

Who holds the gavels

Elizabeth Warren is in line to chair the Senate Banking Committee. She argued that CLARITY did too little for consumers and national security. Sherrod Brown returns to the Senate after beating Jon Husted in Ohio, where crypto-funded committees had reported $52.6 million for Husted or against Brown by mid-October. Brown chaired the same committee until 2025 and has questioned stablecoins for years.

In the House, Maxine Waters is expected to regain sway over financial bills. In 2025 she introduced the Stop TRUMP in Crypto Act, which would limit crypto business by elected officials and their families. Bryan Steil, the Republican who ran the House digital assets subcommittee, lost his Wisconsin seat.

What Democrats ask for

Democratic senators set out their terms during the CLARITY talks:

  • ethics rules for officials who hold or sell crypto, aimed at the Trump family’s ventures;
  • tougher measures against illicit finance;
  • consumer protection, including limits on interest paid on stablecoins.

With both chambers, Democrats also gain subpoena power. They can open hearings on Trump-linked crypto businesses and slow the confirmation of regulators.

How it could help

Any market structure law needs 60 Senate votes, and neither party holds 60. A bill that Democrats co-write would outlast SEC and CFTC rules, which the next commission can rewrite. Jerome de Tychey, president of Ethereum France, told Cointelegraph that “nothing will pass without cross-partisan support”. He called conflict-of-interest and customer protection rules things a mature industry should welcome, and pointed to the EU’s MiCA.

Marcin Kaźmierczak of RedStone told Decrypt a Democratic Congress “may even be good for the industry in one way”. Fred Hsu of D3 said the industry “can’t rely on one party”.

What it means for you

The GENIUS Act is law and takes effect on 18 January, and its reserve rules do not depend on who runs Congress. If you earn interest on stablecoins, watch the yield clause: Raj Kamal of TransFi told CoinDesk he expects the next draft to limit it. Kalshi traders put the odds of a market structure law by the end of 2027 at 26%. Bitcoin held near $78,000 on Wednesday.

Vote counts come from House and Senate roll calls as compiled by the Solana Policy Institute and The Defiant. Spending figures come from campaign filings reported by Reuters.
